PRIVACY NOTICE (KVKK)

Our company, which operates in the fields set out in detail in the “Articles of Association of EK-CAN İNŞ. OTO. SAN. TİC. LTD. ŞTİ. (KEFALUKA RESORT HOTEL)”, collects and processes your personal data verbally, in writing or electronically as a result of the said activities, both due to the regulations of the Tourism and Revenue Administration authorities and other relevant institutions and due to the contracts we have concluded. This personal data will be used for the purposes of providing services related to our company's fields of activity and improving the quality of these services, carrying out our company's sales, marketing and other activities, and complying with our obligations of record keeping, reporting and information. In addition, your personal data may also be used within the scope of work such as CRM (Customer Relationship Management) applications to be carried out for sales and marketing activities and for improving the quality of the service we offer you.

Your personal data will not be used for purposes other than those stated above without your explicit consent, and will not be shared with or transferred to third parties other than legal obligations and official institutions/organisations.

Our company may share the said personal data only on the basis of the explicit consent of customers, or in the other cases set out in Article 5/2 of the KVKK, primarily the legislation to which we are subject, for the purpose of offering you, our customers, value-added services, opportunities and possibilities and increasing the quality of service, with our affiliates in Türkiye or abroad and with our directly or indirectly related companies and joint ventures, or with public institutions or organisations authorised to request this data as a legal obligation, and — provided that adequate measures are taken — with the institutions, suppliers, authorised dealers/agents/business partners in Türkiye or abroad with whom we have agreements as required by our activities.

In accordance with the legislation in force, your personal data may be collected verbally, in writing or electronically through channels such as our company, our partners, our group companies, our affiliates, our dealers, our agencies and our solution partners with whom we cooperate or have a contractual relationship.

Those who share their personal data with our company have accepted and declared that they are aware that keeping this information accurate and up to date is important both in terms of the rights they hold over their personal data within the meaning of Law No. 6698 on the Protection of Personal Data and in terms of other relevant legislation, and that any liability arising from the provision of incorrect information shall belong entirely to them. You may notify any changes and/or updates regarding the personal data you have shared to (kvkk@kefaluka.com).

Your personal data processed for the purposes stated in this information text shall be deleted, destroyed or anonymised by us and continue to be used as such; pursuant to Article 7/1 of the KVKK once the purpose requiring its processing ceases to exist, and pursuant to Article 138 of the Turkish Criminal Code once the periods determined by the laws have elapsed.

The protection of personal data is an important matter for our company. Our company takes the necessary measures to protect personal data against unauthorised access or against the loss, misuse, disclosure, alteration or destruction of this information.

Our company undertakes to keep your personal data confidential, to take all technical and administrative measures necessary for ensuring confidentiality and security, and to show the necessary care. Although our company takes the necessary information security measures, in the event that personal data is damaged or falls into the hands of third parties as a result of attacks on the website and the system, our company shall immediately notify you and the Personal Data Protection Board of this situation.

By applying to our company, you have the right to;

• a)learn whether your personal data is processed,
• b)request information if it has been processed,
• c)learn the purpose of processing and whether it is used in accordance with that purpose,
• d)know the third parties in Türkiye / abroad to whom it is transferred,
• e)request its correction if it has been processed incompletely / incorrectly,
• f)request its deletion / destruction within the framework of the conditions set out in Article 7 of the KVKK,
• g)request that the transactions carried out pursuant to subparagraphs (d) and (e) above be notified to the third parties to whom it has been transferred,
• h)object to a result arising to your detriment due to its analysis exclusively by automated systems,
• i)claim compensation for the damage in the event that you suffer damage due to its unlawful processing.
